These terms apply to LuxHotel System, a hotel management service designed, built and operated by Bluesquare AI in Tirana, Albania ("we", "us"). They apply to the hotel or business that signs up ("you").
1. Accepting these terms
By opening an account or using LuxHotel System (the "Service"), you agree to these terms. If you do not agree with any part of them, you may not use the Service. If you accept them for a company or a property, you confirm that you are allowed to do so.
2. The Service
LuxHotel System is software you use online, on a subscription (software as a service). Depending on what you choose, it includes:
- a property management system (PMS) for reservations, rooms and guests;
- a channel manager connected to online travel agencies and other booking channels;
- a booking engine for direct bookings on your website;
- guest communication, including a shared inbox and AI Reception on WhatsApp;
- a bar point of sale;
- reports and finance, and rate and inventory management.
To sell on a booking channel you need your own contract with that channel. Its terms apply between you and the channel.
3. Accounts and access
To use the Service you need an account, opened with accurate and complete information. You are responsible for:
- keeping passwords and sign-in codes confidential;
- everything done under your account and by the staff you give access to;
- telling us at once if you notice access that you did not allow.
We may suspend or close an account that breaks these terms.
4. Prices and payment
Prices are those published on our pricing page or agreed with you in writing. The room price is charged per room, per month, and add-ons are charged as shown next to each one. Prices are in euros.
- You pay monthly or yearly, as agreed when you sign up;
- Periods already invoiced are not refunded, except where the law requires it.
If an invoice stays unpaid, we may suspend access after telling you by email.
5. Acceptable use
You agree not to:
- use the Service for anything unlawful;
- try to reach systems or data you are not allowed to access;
- resell or transfer your account to anyone else without our agreement;
- upload viruses, malware or other harmful code;
- copy, modify or distribute our software.
6. Intellectual property and your data
The Service and everything in it, including the software, text, graphics and logos, belong to Bluesquare AI and are protected by intellectual property law.
You keep ownership of your data and of your guests' data. You give us a limited licence to process it only to provide the Service. How we handle personal data is set out in our privacy policy, and we act as your processor for your guests' data.
7. Availability
We work to keep the Service available at all times and tell you by email before planned maintenance. We are not responsible for interruptions caused by third parties outside our direct control, such as internet providers, our hosting providers, Channex or the booking channels themselves.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential loss arising from the use of the Service or from being unable to use it.
Our total liability to you will not exceed the amount you paid us in the 3 months before the event that caused it. Nothing in these terms limits liability that cannot be limited by law.
9. Ending the Service
You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Before then you can ask us for an export of your data.
We may end the Service with 30 days' notice, or immediately if these terms are seriously breached.
10. Governing law
These terms are governed by the law of the Republic of Albania. Any dispute will first be worked through in good faith, and if that fails it will go to the competent courts of Albania.
11. Changes to these terms
We may change these terms. We tell you about material changes by email at least 14 days before they take effect. Using the Service after that date means you accept the new terms.
